The following Terms and Conditions (“Agreement”) govern your access to and use of www.baypointlabs.net (the “Website”), any services offered via this Website, and all related communications, reports, and deliverables you may receive from Bay Point Labs. By accessing or using our Website and services, you agree to these Terms and Conditions. If you do not agree to any portion, do not use our Website or services. 

 

Scope of Services 

Bay Point Labs specializes in laboratory compliance testing and consulting services for cannabis farmers, distributors, manufacturers, and other clients. Services include, but are not limited to, analytical testing, sample assessment, contamination identification, and regulatory consultation. All services are provided in accordance with state and federal laws and Bay Point Labs’ standard operating protocols. 

 

Client Responsibilities 

• Specimen Integrity: Clients are responsible for ensuring proper packaging, labeling, and transport of samples and specimens in accordance with Bay Point Labs’ instructions. Any deviation that compromises sample integrity may affect accuracy, reliability, and reporting of results. Bay Point Labs reserves the right to refuse or invalidate results for samples received in substandard condition. 
• Provision of Information: Clients must provide complete, accurate, and up-to-date information pertaining to specimens, service requests, and any relevant compliance documentation. 
• Compliance: Clients are solely responsible for compliance with applicable laws, regulations, and licensing requirements relating to their own products and activities. 

 

Performance of Services 

• Standard of Care: Testing and consulting services will be performed with reasonable care and skill, following industry-relevant standards, state regulations, and laboratory accreditation/quality guidelines (such as ISO 17025:2017, as applicable). 
• Limitations: The analyses and results provided by Bay Point Labs are limited to the samples delivered and submitted. Bay Point Labs does not guarantee, warrant, or imply suitability of results for any purpose other than those specified in the engagement. 
• Turnaround Times: Estimated completion dates provided are indicative only and subject to change based on sample volume, complexity, and operational factors. 

 

Fees, Payment, and Invoicing 

• Quotes and Pricing: Service requests are subject to written quotation. All prices are exclusive of taxes, fees, and shipping unless specifically stated otherwise. 
• Payment Terms: Invoices are due upon receipt unless otherwise specified in writing. Late payments may accrue fees at 1.5% per month or the highest rate allowed by law. 
• Cancellation and Changes: Requests for cancellation or amendment of orders must be received in writing. Bay Point Labs reserves the right to charge for work performed and costs incurred up to the date of notice. 

 

Confidentiality and Data Protection 

• Data Privacy: Bay Point Labs will treat all client data, samples, and results as confidential. Information will not be disclosed to third parties except as required by law, regulation, or court order, or with your written consent. 
• Intellectual Property: Reports and testing methodologies provided by Bay Point Labs remain the intellectual property of the company, unless explicitly transferred under separate agreement. 

 

Use of Results and Disclaimer 

• Interpretation and Use: The results of analyses provided by Bay Point Labs are for informational, compliance, and quality purposes only. Bay Point Labs does not accept liability for any decision, process, or action taken by the client based on test results. 
• No Medical Advice: Bay Point Labs does not provide medical, therapeutic, or clinical diagnostic services. Results are not intended for human or veterinary health assessment, diagnosis, or treatment. 
• Warranty Exclusion: Except as expressly stated, Bay Point Labs disclaims all warranties, express or implied, including merchantability or fitness for a particular purpose. 

 

Limitation of Liability 

Bay Point Labs’ maximum aggregate liability arising from any claim relating to services, documentation, or breach of contract is limited to the fees paid by the client for the specific service giving rise to the claim. In no event shall Bay Point Labs be liable for loss of profit, indirect, incidental, or consequential damages arising from any engagement. 

 

Indemnification 

Clients agree to indemnify and hold harmless Bay Point Labs and its employees, affiliates, and contractors against any claims, damages, liabilities, or costs arising out of client’s misuse of results, breach of these Terms, or violation of applicable law. 

 

Governing Law 

This Agreement is governed by the laws of the State of California. Any disputes arising from this Agreement shall be resolved in the courts located in California, subject to the terms in the Client Services Agreement. 

 

Amendments 

Bay Point Labs reserves the right to modify these Terms and Conditions at any time. Updates will be posted on the Website, and continued use of the Website or services constitutes acceptance of such changes. 

 

Eligibility & Acceptance 

You must be 18 years or older and legally capable of entering into contracts. 

You authorize that all information you provide is true, accurate, and up-to-date. 

 

Services Description 

We provide marketing strategy, CRM setup, AI powered lead generation, consulting, and related digital marketing services. Any specific service details will be provided in separate written agreements or Scope of Work documents. 

 

Use of Site & Services 

You agree to use the Site and Services lawfully and in accordance with these Terms. 

You must not do any of the following: use Site for spam or illegal activity; reverse engineer our code; spam, harass, or collect others’ data without consent. 

You will not store or process personal information of others unless you have explicit permissions (e.g., consent or legal basis). 

 

Accounts & Passwords 

You are responsible for maintaining the confidentiality of your account and password. 

You agree to notify us immediately of any unauthorized access or loss of your password.
